By accessing this website or initiating an engagement with us, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use this website or our services.

1. Definitions

In these Terms and Conditions, the following terms carry the meanings set out below:

  • "We", "us", "our", "seritanahs" refers to the firm operating under the name seritanahs, at No. 27, Jalan Molek 1/28, Taman Molek, 81100 Johor Bahru, Johor.
  • "You", "Client", "User" refers to any person or entity accessing this website or engaging our services.
  • "Services" refers to any legal or advisory services provided by seritanahs, including property conveyancing, commercial lease structuring, and land subdivision assistance.
  • "Website" refers to the website located at https://seritanahs.live.
  • "Engagement Letter" refers to the written agreement between seritanahs and a client confirming the scope, fee, and terms of a specific matter.
  • "Matter" refers to a specific legal task or file undertaken by seritanahs on behalf of a client.

2. Acceptance of Terms

By using this website, submitting an enquiry, or signing an Engagement Letter, you confirm that:

  • You are at least 18 years of age and legally capable of entering into binding agreements under Malaysian law.
  • If acting on behalf of a company or other legal entity, you have authority to bind that entity.
  • You have read and understood these Terms and agree to be bound by them.

3. Services Provided

seritanahs offers legal services in the area of real estate and property law, including:

  • Residential Property Conveyancing: Sale and Purchase Agreements, title search, stamp duty, state consent, and Land Office registration.
  • Commercial Lease Structuring: Lease drafting, negotiation support, and tenancy risk summaries.
  • Land Subdivision & Title Conversion: Applications under the National Land Code, authority liaison, and feasibility memos.

Services are available to clients throughout Johor and Peninsular Malaysia, subject to the scope confirmed in each Engagement Letter. Service availability may vary by location and matter type.


4. Client Engagement

No solicitor-client relationship is established through the submission of an enquiry form or initial contact. A formal engagement commences only upon:

  • Execution of an Engagement Letter by both parties, or
  • Receipt of an instruction deposit where applicable, alongside written confirmation of scope.

Until a formal engagement is confirmed, any information shared with seritanahs is not subject to legal professional privilege and should not be treated as confidential legal advice.


5. Client Responsibilities

You agree to:

  • Provide accurate, complete, and current information relevant to your matter in a timely manner
  • Promptly notify us of any changes to relevant facts or circumstances
  • Cooperate reasonably with requests for documentation or instructions
  • Not use this website or our services for any unlawful purpose
  • Not upload or transmit any harmful, fraudulent, or misleading content via this website
  • Pay all agreed fees in accordance with the Engagement Letter

Delays caused by a client's failure to provide required information or documentation in a timely manner may affect the timeline of a matter. seritanahs accepts no responsibility for such delays.


6. Intellectual Property

All content on this website — including text, layout, structure, and visual elements — is owned by or licensed to seritanahs. You may not reproduce, distribute, or modify any part of this website without prior written permission.

Documents prepared by seritanahs on your behalf (such as sale and purchase agreements or lease drafts) are prepared for your specific matter and are not to be reused as templates for other transactions without our knowledge.

Any templates, precedents, or methodologies used internally by seritanahs remain our intellectual property.


7. Fees & Payment

Fees for each service are as quoted in the Engagement Letter or as displayed on this website. All amounts are in Malaysian Ringgit (RM) unless otherwise stated.

  • Disbursements: Government fees, stamp duty, filing charges, surveyor fees, and other third-party costs are payable by the client in addition to professional fees. These will be itemised in a disbursement statement.
  • Payment timing: An upfront deposit may be required to commence work. Remaining fees are due at milestones specified in the Engagement Letter.
  • Accepted methods: Bank transfer, online banking (FPX), or as otherwise agreed in writing.
  • Late payment: seritanahs reserves the right to pause work on a matter if outstanding invoices are not settled within the agreed period.
  • Refunds: Fees for work already completed are not refundable. Where a matter is terminated before completion, fees for work done up to that point, plus any disbursements incurred, remain payable.

8. Service-Specific Terms

8.1 Residential Property Conveyancing

Timeline estimates (three to four months) are indicative and subject to the response time of third parties including the Land Office, State Authority, and financial institutions. We will keep you informed at each milestone. Delays attributable to government authorities or counterparties are outside our control.

8.2 Commercial Lease Structuring

Our scope covers drafting and up to three rounds of counterparty correspondence. Additional rounds of negotiation beyond this scope will be quoted separately. We do not advise on the commercial viability of a tenancy or predict counterparty behaviour.

8.3 Land Subdivision & Title Conversion

Approval by State Authority or Land Administrator is subject to governmental discretion and applicable planning laws. seritanahs's role is to prepare, submit, and follow up applications diligently. We do not warrant approval, nor do we control the timeline set by relevant authorities. The stated range of six to twelve months is a general guide only.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law:

  • seritanahs's liability in connection with any matter shall not exceed the total professional fees paid by the client for that specific matter.
  • We shall not be liable for indirect, consequential, or speculative losses, including loss of profit, loss of opportunity, or reputational damage.
  • We shall not be liable for losses arising from your failure to provide accurate information, delayed instructions, or non-compliance with our requests.
  • Nothing in these Terms limits liability for fraud, wilful misconduct, or any matter that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless seritanahs, its staff, and associates from any claims, losses, costs, or expenses arising from: (a) your breach of these Terms; (b) your provision of inaccurate or misleading information; or (c) your violation of any applicable Malaysian law in connection with a matter.


12. Confidentiality

seritanahs is bound by professional obligations of confidentiality under the Legal Profession Act 1976 and related rules. Information shared with us in the course of a formal engagement will be held in confidence, subject to disclosure required by law, court order, or regulatory authority.

Note that communications via unsecured email prior to formal engagement are not covered by legal professional privilege. We recommend using our official channels for sensitive information.


13. Termination

Either party may terminate a formal engagement by providing written notice, subject to the terms of the Engagement Letter. Upon termination:

  • All fees for work completed up to the date of termination remain due.
  • seritanahs will provide a reasonable handover of relevant documents and file notes, subject to outstanding fees being settled.
  • seritanahs reserves the right to withdraw from a matter where continued engagement would conflict with professional ethics obligations or where there has been a material breach of these Terms by the client.

14. Governing Law & Dispute Resolution

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of Malaysia. The parties submit to the non-exclusive jurisdiction of the courts of Malaysia.

Before initiating formal proceedings, we encourage clients to raise concerns with us directly. We will make reasonable efforts to resolve disputes through discussion. Where this is not possible, parties may consider mediation through the Malaysian Mediation Centre before proceeding to litigation.

Complaints regarding professional conduct may be directed to the Bar Council Malaysia or the Advocates and Solicitors Disciplinary Board.


15. General Provisions

  • Entire Agreement: These Terms, together with any signed Engagement Letter, constitute the entire agreement between the parties regarding their subject matter.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
  • No Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  • Notices: All formal notices should be sent in writing to the address or email below.

16. Changes to These Terms

We may revise these Terms periodically. The revised version will be posted on this page with an updated "Last Updated" date. For active client matters, material changes will be communicated directly. Your continued use of this website or our services after revised Terms are posted indicates your acceptance of the changes.
